1. Acceptance of Terms

By accessing or using the Blue Collar Academy website, mobile application, or services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our Service.

2. Description of Service

Blue Collar Academy provides an all-in-one CRM platform combined with coaching services designed specifically for blue-collar businesses including roofing, HVAC, plumbing, electrical, and related industries.

Our services include:

• Customer relationship management (CRM) software
• Lead management and pipeline tools
• Estimate and invoice generation
• Project management capabilities
• Business coaching and training
• Mobile applications for field work
• Custom branding solutions (Ultimate Plan)

3. Trial Period and Subscription Terms

Subscription Plans:

• Pro Plan: $200/month + $30 per additional user
• Ultimate Plan: $999/month (12-month commitment required)

Subscriptions automatically renew unless canceled. You may cancel your subscription at any time through your account settings or by contacting our support team.

4. Payment Terms

Payment is due monthly in advance for Pro Plan subscriptions. Ultimate Plan requires annual payment or monthly payments with a 12-month commitment. All fees are non-refundable except as required by law.

We reserve the right to change our pricing with 30 days’ notice to existing subscribers. Price changes will not affect your current billing cycle.

5. User Accounts and Responsibilities

Account Security:

• You are responsible for maintaining the confidentiality of your account credentials
• You must notify us immediately of any unauthorized use of your account
• You are responsible for all activities that occur under your account

Acceptable Use:

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Violate any applicable laws or regulations
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to the Service
• Share your account with unauthorized users

6. Data and Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Your Data:

• You retain ownership of all data you input into the Service
• We will not share your business data with third parties without your consent
• You are responsible for backing up your data
• Upon termination, you may export your data for 30 days

7. Intellectual Property

The Service, including all software, content, trademarks, and other materials, is owned by Blue Collar Academy or our licensors and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the Service solely for your business purposes in accordance with these Terms.

8. Coaching Services

Our coaching services are provided for educational and informational purposes. While we strive to provide valuable business insights:

• Results may vary based on individual effort and market conditions
• We do not guarantee specific business outcomes or revenue increases
• Coaching advice should be evaluated in context of your specific situation
• You are solely responsible for implementing any strategies discussed

9. Service Availability

We strive to maintain 99.9% uptime but cannot guarantee uninterrupted service. We may perform maintenance that temporarily affects service availability, and we will provide reasonable notice when possible.

10. Limitation of Liability

Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold Blue Collar Academy harmless from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Termination

Either party may terminate these Terms at any time:

• You may cancel your subscription through your account settings
• We may terminate your access for violation of these Terms
• Upon termination, your access to the Service will end
• Certain provisions (including payment obligations, liability limitations, and indemnification) survive termination

13. Modifications to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Your continued use of the Service after such notification constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States and the state in which Blue Collar Academy is headquartered, without regard to conflict of law principles.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to participate in class action lawsuits.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
